    How to alter E-MOA & E-AOA in case of alteration in name clause of private limited company?
    As these are filed electronically and subscriber sheet is signed on back date.

    Reporting Company -> Body Corporate holding 0.17 -> Partnership Firm 65.45 -> 2 partners holding 50% stake each.

    Should SBO be Declared? If Yes, How to execute it in the e-Form BEN – 2?

    • I think, BEN-2 is required to be filed. You may ask body corporate about their indirect holding, partnership firm about its indirect holding through partners and ask them to submit declaration in BEN-1.

  3. Hi mam
    shall we put un audited figures for DPT 3 as for many companies audit has yet to be done…..please suggest at earliest

    • Networth calculation shall be as per last financial year which was audited as on 31.03.2018, but for outstanding amount lying as on 31.03.2019 those can be based upon un audited balance sheet.

    Unsecured loan from Director
    01/04/2014 = Rs. 120000/-
    Addition = Rs. 60000/-
    Deduction = Rs. 50000/-
    31/03/2019 = Rs. 130000/-

    which amount mentioned in OTR and AR?

    • As information provided by you, as per my view, for OTR, you can take Rs. 130000/- and for AR- you have to get information for amount outstanding for the period 01.04.18 to 31.03.2019.
      This is my general opinion.

  5. DPT-3 (Onetime Return & Annual Return) me 31/03/2019 ki outstanding hi deni hai na?
    i mean Onetime return me total outstanding aur annual return (Particulars of transactions) me grouping ke hisaab se outstanding details fill up karni hai

  6. 350 creditors MSME me registered hai jinko payment karne me 45 days se jyada delay ho gaya hai to MSME form-1 me kese report karna hai?
    half yearly return me invoice date ke hisab se details leni hai ya payment ke hisab se?

    • If number of creditors are more than 99 then you can file multiple MSME forms because you can fill up data of 99 creditors in one MSME form.
      In Half year return , fill up details from date of invoice.

  7. What should be Date of Closing of Accounts in Form DPT-3?

    If Credit Period is 90 Days for MSME Registered Supplier and amount is outstanding as on 22-01-2019. Do we still need to report under Form MSME – I?

    • Whatever may the outstanding amount as on 22.01.2019, you should report to Government in MSME -1 irrespective of number of credit period. As per the notification, one should report for outstanding amount as on 22.01.2019 who could not pay amount within 45 days.

  11. for MSME Form-1,
    1) sirf MSME me registered hai aur jinko payment karne me 45 days se jyada delay ho gaya hai unhi creditors ki details file karni hai ya jo registered nahi hai par criteria me fall karte hai unko bhi consider karna hai?
    2) 30/05/2019 tak intial (22/01/2019) and half yearly (31/03/2019) dono return file karne hai ya sirf initial hi file karna hai?

    • As per my view, MSME form 1 is to be submitted by company for the outstanding amount to be paid to those creditors who are registered MSME.
      Both Initial and Half year MSME form 1 is to be submitted on or before 30th May 2019. Please refer General Circular No. 01/ 2019 (Extension of filing of MSMSE form 1) dated 21.02.2019 in which it is specified that MSME Form 1 is to be submitted from the date when the e-form is deployed on MCA Portal. The form was available from 01.5.2019 so it is to be submitted before 30.05.2019.

  12. For MSME form 1)registered suppliers Ko hi consider karna hai ya usko bhi ho registered nahi hai par criteria me fall karte hai use bhi consider karna hai
    2) 22/01/2019 aur 31/03/2019 do form file karna hai ya sirf initial

    • Every corporate is needed to check whether MSME supplier is registered or not. The company can check registration form or invoice sent by MSME vendor or email confirmation about registration. As per my view, MSME form 1 is to be submitted by company which has to pay outstanding amount to registered MSME suppliers.

      The company is required to file initial MSME form 1 with outstanding amount as on 22.01.2019 and half yearly as on 31st March. Filing of initial and half year is to be done before 30th May, 2019. Please refer General Circular No. 01/ 2019 dated 21.02.2019. Since MSME Form 1 is available on MCA portal from 01.05.2019, due date of filing of this form is 30.05.2019.
